West Bengal PCB brings in Comprehensive Inspection Policy to prevent and control pollution in the State and to facilitate ease of doing business

The West Bengal Pollution Control Board (“WBPCB) has issued a “Comprehensive Inspection Policy” (“Policy”) in order to implement the provisions of the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder, for prevention and control of pollution in the state.

In order to implement the Policy, the WBPCB has made Risk wise categorisation of red/orange/green and white category industries.

The WBPCB has laid down the following Inspection Procedure for facilitating ease of business.image001 (2)

Further, the WBPCB has decided a frequency of inspection in the manner given in the tabular column below:

The Inspection Policy will be applicable to the concerned employer/entrepreneur/ occupier under the provisions of the following Legislations:

  1. i)The Water (Prevention and Control of Pollution) Act, 1974.

  1. ii)The Air (Prevention and Control of Pollution) Act, 1981.

                      iii)  Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.

Further, a selection procedure has been laid down for the third-party inspector.

Please note that each of the industries registered under the Board will be allotted a unique identification number known as “UNIT CODE” which will have to be mentioned to the third party during engagement for inspection by the industry.
