The Ministry of Environment, Forest and Climate Change (“MoEFCC”), through a notification dated 31^st December, 2019 has amended the Ozone Depleting Substances (Regulation and Control) Rules, 2000 (“Principal Rules”), with effect from 1^st January, 2020.

Key Highlights:

1. Issuance of license for import of HCFC-141b (Hydrochlorofluorocarbon-141b) will be stopped from 1st January 2020.

1. The phase-out date for manufacture of pre-blended polyols has been preponed from 1^st January, 2022 to 1^st January, 2020. The date of 1^st January, 2022 was set by the Ozone Depleting Substances (Regulation and Control) Amendment Rules, 2014 (“2014 Amendment Rules”).

1. With this amendment, the MoEFCC has included  pre-blended polyols under pre-polymers. Under Schedule VII of the Principal Rules, Pre-polymers are included as a product containing ozone depleting substances for which regulations of import and export have been put in place by the 2014 Amendment Rules.
