Government issues two new Draft Regulations under the Consumer Protection Act, 2019; invites comments by 28.01.2020

In a Notification dated 7th January, 2020, the Ministry of Consumer Affairs, Food & Public Distribution (“Ministry”) has issued the following new Draft Regulations under the provisions of the Consumer Protection Act, 2019:

  1. The Consumer Protection (Consumer Commission Procedure) Regulations, 2020 : The Regulations deal with the Consumer Commission which will be set up in order to hear the aggrieved parties / complaints under the provisions of the Act.

  1. The Central Consumer Protection Authority (Submission of Inquiry or Investigation by the Investigation Wing) Regulations, 2020 : These Regulations deal with the manner and process of enquiry to be conducted in cases falling under the purview of the Act.

The Ministry invites comments and suggestions on the Regulations which can be sent to dscpu-ca@nic.in or to Deputy Secretary (CPU), Department of Consumer Affairs, Room No. 461, Krishi Bhawan, New Delhi-110001 by 28th January, 2020 after which the Draft Regulations will be taken into consideration.

Background:

 

The Consumer Protection Bill which was earlier released for public comments, had received the President’s assent and was notified as the Consumer Protection Act, 2019  (“Act”) on 9th August, 2019. The present Draft Regulations have been published under the provisions of the Act on matters that are required to be notified under the Act.
