FSSAI issues instructions regarding levy of fees and charges on food importers

Pursuant to the 24th meeting of the Food Safety and Standards Authority of India (“FSSAI”) held on 21st September, 2017, the FSSAI has, vide an Order dated 8th November, 2017, issued instructions regarding the levy of fees and charges for regulating food imports.

 

Key Highlights of the Order:

 

The FSSAI has instructed that the following amounts will be charged from food importers:

  1. For Visual Inspection, the importer or his Custom House Agent (“CHA”) has to make an online payment of Rs.2000 along with the lab testing fee.
  2. If the importer does not turn up for the visual inspection, even after two opportunities, the Authorised Officer (“Officer”) of FSSAI may draw the sample ex-parte and charge the importer with a penalty of Rs.2000 before the issuance of the NOC/NCC. Till the provisions of such payment is made online, the Officer may collect the fee online.
  3. The charge for first review appeal is Rs. 2000 and for second review appeal before the CEO is Rs. 5000. The review application process will be done offline till the provisions for the process is made online.

 

Background:

The regulations under Chapter III being Regulations 5(2)(d) and 5(4) and under Chapter XI being Regulation 15(2)(a) of the Food Safety and Standards (Import) Regulations, 2016 were brought to the notice of the FSSAI during its 24th meeting wherein it decided that the specified fees shall be charged from the food importers and the FSSAI may review such fees from time to time.
