MCA releases an advisory on specific e-Forms related to Charge

The Ministry of Corporate Affairs, through the News and Important Updates section, has released an Advisory with specific remarks against Charge related e-Forms, i.e., CHG-1/9, CHG-8, CHG-4, RD-1 and GNL-5.

Form Advisory
CHG-1/9 The advisory states that e-Form CHG-1/9 containing changes of the Companies (Amendment) Ordinance 2019 is under progress. However, the existing form CHG-1/9 has been restricted for registering charges created or modified on or after 02.11.2018 if the form is filed after 120 days of the date of such creation or modification.  The Advisory also states that in case charge is created or modified after 2nd November 2018 and 120 days have expired therefrom, the form CHG-1/9 cannot be filed to register such charges and there is no option for condonation of delay.
CHG-8 The advisory states that e-Form CHG-8 containing changes of the Companies (Amendment) Ordinance, 2019 is under progress.
CHG-4 Changes to CHG-4 based on the Companies (Amendment) Act, 2017 have been made in the form CHG-4 since December 25, 2018.  However, the forms filed between 5th July, 2018 to 24th December 2018 where condonation is asked for, the stakeholders have been advised to contact the jurisdictional Registrar of Companies to request for an additional resubmission chance. On resubmitting the revised form, there will be no requirement of condonation to be filed if form is filed after 30 days and within 300 days of satisfaction of charge.
RD-1 The Form RD-1 is pending deployment for ‘Change in financial year’ and ‘Conversion of public company to private company’, and the stakeholders have been advised to continue to file such application in form RD-1 by selecting ‘Others’ option and giving the details in the relevant text box, and the same will be accepted for processing by the Regional Director.

 

RD GNL-5 Development of RD GNL-5 containing changes with reference to the Companies (Amendment) Ordinance 2019 is under progress.
