FSSAI operationalizes the Draft Food Safety and Standards (Import) First Amendment Regulations, 2017, effective since 6th December, 2017
Further to the update in trail email, the Food Safety and Standards Authority of India (“FSSAI”) has, through a direction dated 13th December, 2017, informed that while the Draft Food Safety and Standards (Import) First Amendment Regulations, 2017 (“Draft Regulations”) were issued on 30th November, 2017 and comments invited from the stakeholders, it has been decided to operationalize the Draft Regulations with effect from 6th December, 2017, since the finalization of the Draft Regulations will take some more time.
These Draft Regulations have been issued by FSSAI in exercise of powers conferred to it under Section 18(2)(d) of the Food Safety and Standards Act, 2006 (“Act”) which states:
‘Section 18. General principles to be followed in Administration of Act:
(2) The Food Authority shall, while framing regulations or specifying standards under this Act–
(d) ensure that there is open and transparent public consultation, directly or through representative bodies including all levels of panchayats, during the preparation, evaluation and revision of regulations, except where it is of opinion that there is an urgency concerning food safety or public health to make or amend the regulations in which case such consultation may be dispensed with :
Provided that such regulations shall be in force for not more than six months.’
