Draft Gujarat Factories (Fourth Amendment) Rules, 2017 published by Gujarat Labour and Employment Department
The Labour and Employment Department of the Government of Gujarat (“Department”), has published draft of Gujarat Factories (Fourth Amendment) Rules, 2017 (“Draft Rules”) proposing to amend the Gujarat Factories Rules, 1963 (“Principal Rules”). The Department has invited suggestions or objections on the Draft Rules within a period of 45 days from the date of notification of Draft Rules, being September 18, 2017.
The Draft Rules aims to substitute the Rule 8A of the Principal Rules with a new rule 8A (“New Rule”), titled, “When license deemed to be granted or renewed”. The New Rule states that an application for the grant or renewal of license shall be deemed to have been duly made only if it is in the specified form, accompanied by a treasury receipt, a crossed cheque, a crossed Indian Postal Order, or as the case may be, an invoice for book adjustment, for payment of the fees in accordance with the Schedule annexed to Rule 4 of the Principal Rules.
Additionally, such an application for the grant or renewal of license shall be deemed to be duly granted until an order to the contrary or an intimation stating that the grant or renewal of the license has been refused is communicated to such person within 90 days. The period of 90 days shall be calculated from the date of expiry of the license.
