Department of Labour and Employment, Tamil Nadu, publishes draft Amendment to the Factories Rules
The Labour and Employment Department of the Government of Tamil Nadu, has published a draft amendment to the Factories Rules, 1950, inviting comments, suggestions and objections on the same within a period of 45 days from September 27, 2017.
The Amendment aims to introduce a new Section 12-B, titled, “Medical Examination by Certifying Surgeon”. The provision mandates both new and existing employees to be examined by a certified surgeon on a routine basis so as to ascertain their physical health and ability to work. New employees shall be examined within 15 days of their joining and existing employees shall be examined at least once every six months.
On the basis of the examination, the certifying surgeon shall issue a fitness certificate enabling the employee to continue working in the said premises. If any employee is no longer considered fit for employment, the certifying surgeon shall record his findings on the same and have him recommended to be suspended from work. The employee so suspended shall be provided with alternate placement facilities until he is fully incapacitated or is declared fit for employment once again by the certifying surgeon.
