Andhra Pradesh Pollution Control Board exempts white category industries from mandatory inspection in addition to their exemption from obtaining CTO / CTE certificates

The Andhra Pradesh Pollution Control Board (“Board”) had earlier, pursuant to Central Pollution Control Board’s direction dated March 7, 2016, exempted the white categoryindustries from obtaining consent to establish and consent to operate.

Now, in line with the Business Reforms Action Plan, 2019 under the “Ease of Doing Business” initiatives of the Department of Industrial Policy and Promotion under the Ministry of Commerce and Industries, Government of India, the Board has, in a Circular dated March 29, 2019 (“Circular”), announced that white category industries shall be exempted from obtaining consent to establish and consent to operate from the Board and shall also be exempted from mandatory inspection.

However, the Circular clarifies that inspections against such white category industries shall be invoked in case there are specific complaints or court cases against them.
