UP Government amends the Inter-State Migrant Workmen Act, 1979 by digitizing the filing process and fixing the timelines for grant of registration & licensing of undertakings; Effective 10-01-19

The Department of Labour, Government of Uttar Pradesh has through a Gazette Notification dated January 10, 2019 amended the Interstate Migrant Workmen (Regulation of Employment and Conditions of Service) 1979 (“Act”), as applicable to the State of Uttar Pradesh.

Background

The amendment has been introduced to address the growing demand for fixing the timelines for registration and licensing of undertakings under the Act. After due consultation with the association of employers and trade unions, it has been decided that both registration and licensing of establishments would be processed within one day from the date of submission of application. Further, the amendment has also introduced online submission of applications on the department’s portal for registration and licensing of establishments.

Key Highlights of the Amendment:

  1. The amendment has clarified that once an application for Registration of an Undertaking or for grant of license is filed, the same shall be granted or refused within one working day and if the time period of one day expires, the registration will be deemed to have been.
  2. Application for registration for establishments/grant of license can now be done through the department’s online web portal and that the registration certificate/license shall be given automatically over e-mail.
