Unauthorized Flexes/Advertisement Boards to be charged under the provisions of IPC; action to be taken against perpetrators, says Kerala High Court

In a recent order in Writ Petition (C) No. 22750 & 25784 dated November 13, 2018, the Kerala High Court has directed that every unauthorized Flex Board / Bill Boards / Advertisement Boards / Banners / Flags etc. should be removed and all offenders be prosecuted under the provisions of the Police Act and the Indian Penal Code.

Background:

The Kerala High Court had originally, on September 18, 2018, directed the removal of all illegal Large Flex Board/Bill Boards/Advertisement Boards which have been erected without taking proper permission from the Local Government Authorities and without payment of the necessary fees.

The Court while passing the order on November 13, 2018, observed that even after the ban, private enterprises/individuals have continued to erect these illegal Boards with the aid and assistance of political influences. Therefore, through this order, the Court has sought the assistance of the Police Authorities and the Election Commission to curb the violation of the previous orders.
