Telangana Labour Department proposes to amend Factories Rules, makes it mandatory for employers to give Personal Protective Equipment to workers; suggestions invited till 19th January, 2019

The Labour Employment Training and Factories Department, Government of Telangana through an order dated 3rd December, 2019, brought in a draft to amend Rule 61-N (deals with protective equipment) of the Telangana Factories Rules, 1950 (“Rules”). Suggestions have been invited for the said draft till 19th January, 2019.

Presently the Rule 61-N of the Rules only states that “The inspector may having regard to the nature of the hazards involved in work and process being carried out, order the Occupier or the Manager in writing to supply to the workers exposed to particular hazard any personal protective equipment as may be found necessary”.

However, with this amendment, the Government of Telangana will make it mandatory to provide workers with their personal protective equipment (“PPE”) and has gone on to list down various types of protective equipment under this amended Rule 61-N as PPE. The list of PPEs as per the proposed amendment are as follows:

  1. Safety Helmet;
  2. Protective Footwear;
  3. Safety Goggles and Spectacles;
  4. Equipment for Eye and Face Protection during Welding;
  5. Gloves and Protective Clothing;
  6. Ear Protection when exposed to Noise;
  7. Respiratory Protection; and
  8. Other Protective Equipment
