Tamil Nadu Labour Department proposes revisions to various fees under the Tamil Nadu Contract Labour (Regulation and Abolition) Rules, 1975

In a notification dated 21st June, 2017, the Tamil Nadu Labour and Employment Department (“Department”) has proposed amendments to the Tamil Nadu Contract Labour (Regulation and Abolition) Rules, 1975 (“Rules”).

Key Highlights of the draft amendment:

  • The draft amendment proposes to increase the application fee for the license of the workmen to Rs. 500/- from Rs.100/-
  • The draft amendment proposes to revise the fees to be paid for the grant of certificate of registration of an establishment for employing workmen on contractual basis on any day.

The proposed fees for obtaining registration certificate are as follows:

(a) If contract workmen does not exceed 50- Rs. 2,500/-

(b) If contract workmen exceeds 50 but does not exceed 100- Rs. 5,000/-

(c) If contract workmen exceeds 100 but does not exceed 200- Rs.10,000/-

(d) If contract workmen exceeds 200- Rs.20,000/-

  • The draft amendment proposes to revise the fees to be paid for the grant orrenewalof a license for employing workmen on contractual basis on any day. The proposed fees for renewal of registration certificate are as follows:

(a) If contract workmen does not exceed 50- Rs. 2,500/-

(b) If contract workmen exceeds 50 but does not exceed 100- Rs. 5,000/-

(c) If contract workmen exceeds 100 but does not exceed 200- Rs.10,000/-

(d) If contract workmen exceeds 200- Rs.20,000/-

  • The draft amendment proposes to amend the validity of the license. It is proposed the validity should remain in force for a period of 2 consecutive calendar years commencing from the year in which the license was granted or renewed. Currently, the validity of the license remains in force up to and inclusive of the 31st December of the year for which the license was granted or renewed.
  • The draft amendment proposed to increase the fee for the amendment of license to Rs. 500/- from Rs.25/-.
  •   It is proposed to increase the  fee for the grant ofa duplicate registrationcertificate/license to Rs. 500/- from Rs.50/-.
  • It is proposed to revise the fees to be paid for the grant of temporary certificate of registration for employing workmen on contractual basis on any day.

The proposed fees for grant of temporary certificate of registration are as follows:

(a) If the workmen does not exceed 50- Rs. 500/-.

(b) If the workmen exceeds 50 but does not exceed 100- Rs. 1,000/-.

(c) If the workmen exceeds 100 but does not exceed 200- Rs. 2,000/-,

(d) If the workmen exceeds 200- Rs. 4,000/-.
