Tamil Nadu Labour Department issues the Shops and Establishments (Amendment) Act, 2017

The Tamil Nadu Labour Department has issued the Tamil Nadu Shops and Establishments (Amendment) Act, 2017(“Amendment Act”) thereby amending the Tamil Nadu Shops and Establishments Act, 1947(“Principal Act”).

The Amendment Act will come into force such date as the State Government may, by notification, appoint.

The Amendment Act has substituted the existing penalty provision (i.e. Section 45) with a new one.

(1) As per the Amendment Act, whoever contravenes Sections 7, 9 to 11, 13 to 23, 25, 26, 29 to 41 and 47 of the Principal Act, relating to Opening and Closing hours of shop, Daily and weekly hours of work in shops, Spread over of periods of work, Closing of shops and grant of holidays, Opening and closing hours etc., will be punishable with:

– For the first offence: Fine upto Rs. 5,000/-;

-For the second offence/subsequent offence: Fine upto Rs.10, 000/-.

Earlier, under Section 45(1) of the Principal Act, Any employer who contravenes any of the provisions of Section 7, 9 to 11, 13 to23, 25, 26, 29 to 41 and 47 relating to Opening and Closing hours of shop, Daily and weekly hours of work in shops, Spread over of periods of work, Closing of shops and grant of holidays, Opening and closing hours etc. was punishable for a first offence, with:

– For the first offence Fine upto Rs to 25 rupees;

-For the second offence/subsequent offence: Fine upto Rs Rs.250.

(2) And whoever contravened the provisions of section 8 was punishable, for a 1st offence, with fine which may extend to Rs. 10 and for a second or subsequent offence with fine which may extend to Rs.100

After the Amendment Act comes into force, not only the employer but any person contravening Sections 7, 9 to 11, 13 to 23, 25, 26, 29 to 41 and 47 of the Principal Act relating to Opening and Closing hours of shop, Daily and weekly hours of work in shops, Spread over of periods of work, Closing of shops and grant of holidays, Opening and closing hours etc will be liable to pay an increased amount of fine for the first offence and for the second offence/subsequent offence.
