Tamil Nadu declares Automobile Manufacturing Industry as Public Utility Service for six months under Industrial Disputes Act, w.e.f. 27th November, 2019

The Labour and Employment Department of Tamil Nadu, through a notification in the Official Gazette dated 27th November, 2019, has  declared the “Automobile Manufacturing Industry” as a Public Utility Service under the Industrial Disputes Act, 1947, for a period of six months, w.e.f. 27th November, 2019.

The First Schedule of the Industrial Disputes Act, 1947 (“Act”) specifies the industries which may be declared as a Public Utility Service under Section 2 (n) (vi) of the Act. However, Section 2 (n) (vi) also specifies that such industries can be declared as a Public Utility Service not more than six months at the first instance and then be extended from time to time through a notification, not extending for more than six months at a time.
