Rajasthan State Pollution Control Board directs industries, having residential colonies or townships, to get separate environmental clearance

The Rajasthan State Pollution Control Board (“Board”) vide an office order dated 2nd January, 2018, has directed all industries having residential colonies or townships for residential purpose of their employees, whether located within the same premises of the industrial unit or outside the premises of such unit, to obtain separate environmental clearance, as applicable under the Environmental Impact Assessment (“EIA”) notification dated 14th September, 2006 (please refer to the attached document “EIA Notification dated 14th September, 2006”).

Such industries are also required to obtain separate Consent to Establish and Consent to Operate for such township or colony, with respect to its plot area and built-up area, under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 from the Board.

Background: 

The EIA notification dated 14th September, 2006 and the office order of the Board dated 7th March, 2013 (please refer to the attached document “Office Order dated 7th March, 2013”) laid down the requirement of construction projects or residential townships, of various categories, to obtain Consent to Establish and Consent to Operate from the Board. This Office order has been issued pursuant to these notifications.
