Odisha PCB directs Occupiers of Health Care Facilities to obtain authorisation under the Biomedical Waste Management Rules, 2016, if not already obtained

In a recent notice dated 23rd October, 2017, the State Pollution Control Board, Odisha (“OSPCB”), has issued a notice to all Occupiers of Health Care Facilities (“Occupier of HCFs”) and Operator of Common Biomedical Waste Treatment and Disposal Facilities (“Operator of CBWTDFs”) reiterating the requirements under the Biomedical Waste Management Rules, 2016 (“Rules”), which include segregation of waste as per colour codes, phasing out chlorinated plastic bags, addition of Bar Code and Global Positioning System, filing of Annual Report and others.

Vide this notice, OSPCB has directed all Occupier of HCFs who have not obtained an authorisation under the Rules yet and are handling biomedical waste (irrespective of the quantity), to apply for online authorisation in Form II as per Rule 10 of the Rules within one month.

Occupiers of HCFs and Operator of CBWTDFs will be liable under Section 5 and Section 15 of the Environment (Protection) Act, 1986, for damages caused to the Environment or the public due to improper handling of bio-medical waste.
