Now, Principal Employers / Contractors in Tamil Nadu Must Also submit proof of online payment made through online portal of Department of Labour at the time of applying for registration / licence / renewal

In a notification dated 26th June, 2019, the Tamil Nadu Labour and Employment Department (“Department”) has notified certain amendments (“Present Amendment”) to the Tamil Nadu Contract Labour (Regulation and Abolition) Rules, 1975 (“Principal Rules”).

Background:

On February 21, 2018, the Department notified certain amendments to Rule 17, Rule 21 and Rule 29 of the Principal Rules, where an online mechanism of payment was introduced at the time of applying for registration / licence / renewal.

Present Status:

The Present Amendment has further brought about changes to the above-mentioned provisions where it has introduced the requirement to also submit proof of online payment made through online portal of Department of Labour at the time of applying for registration / licence / renewal.

In light of the above, we have compared the Present Amendment vis-à-vis the updated Principal Rules for your easy reference.

Principal Rules Present Amendment
17. Manner of making application for registration of establishments-

 

(2) The application referred to in sub-rule (1) shall be accompanied by a treasury receipt or online payment through online portal of Directorate of Industrial Safety and Health showing payment of the fees for the registration of establishment.

 

(3) Every application referred to in sub-rule (1) shall be made through online portal of Directorate of Industrial Safety and Health or personally delivered to the Registering Officer or sent to him by registered post.

17. Manner of making application for registration of establishments-

 

(2) The application referred to in sub-rule (1) shall be accompanied by a treasury receipt or online payment through online portal of Directorate of Industrial Safety and Health or proof of online payment made through online portal of Department of Labour showing payment of the fees for the registration of establishment.

 

(3) Every application referred to in sub-rule (1) shall be made through online portal of Directorate of Industrial Safety and Health or through online portal of Department of Labour or personally delivered to the Registering Officer or sent to him by registered post.

21. Application for a license-

(3) Every such application referred to in sub-rule (1) shall be made through online portal of Directorate of Industrial Safety and Health or personally delivered to the licensing officer or sent to him by registered post.

 

(5) Every application referred to in sub-rule (1) shall also be accompanied by a treasury receipt or online payment through online portal of Directorate of Industrial Safety and Health showing –

 

(i) the deposit of the security at the rates specified in Rule 24.

 

(ii) the payment of fees at the rates specified in Rule 26.

21. Application for a license-

 

(3) Every such application referred to in sub-rule (1) shall be made through online portal of Directorate of Industrial Safety and Health or through online portal of Department of Labour or personally delivered to the licensing officer or sent to him by registered post.

 

(5) Every application referred to in sub-rule (1) shall also be accompanied by a treasury receipt or online payment through online portal of Directorate of Industrial Safety and Health or proof of online payment made through online portal of Department of Labour showing –

 

(i) the deposit of the security at the rates specified in Rule 24.

 

(ii) the payment of fees at the rates specified in Rule 26.

29. Renewal of license-

 

(2) Every such application shall be in Form VII in triplicate…

2A. Every application referred to in sub-rule (2) shall be made through online portal of Directorate of Industrial Safety and Health or personally delivered to the licensing officer or sent to him by registered post:

 

Provided that such application shall be accompanied by a treasury receipt or online payment through online portal of Directorate of Industrial Safety and Health, evidencing the payment of appropriate fee.

29. Renewal of License-

 

(2) Every such application shall be in Form VII in triplicate…

 

2A. Every application referred to in sub-rule (2) shall be made through online portal of Directorate of Industrial Safety and Health or through online portal of Department of Labour or personally delivered to the licensing officer or sent to him by registered post:

 

Provided that such application shall be accompanied by a treasury receipt or online payment through online portal of Directorate of Industrial Safety and Health or proof of online payment made through online portal of Department of Labour evidencing the payment of appropriate fee.
