MOHFW extends timeline within which all implantable medical devices / CT scan / MRI equipment’s / X-ray machines / Dialysis machines, etc. will be considered as ‘Drugs’ till 01.04.2021

The Ministry of Health and Family Welfare (“Ministry”) has extended the timeline within which the list of devices will be considered to be ‘drugs’ as per the Drugs and Cosmetics Act, 1940 from 1st April, 2020 to 1st April 2021.

1) All implantable Medical Devices

2) CT scan equipment

3) MRI equipment

4) Defibrillators

5) Dialysis machine

6) PET equipment

7) X-Ray machine

8) Bone marrow cell separator

In another Notification dated 27th December, 2019 the Central Drugs Standard Control Organisation (“CDSCO”) extends the timeline within which the following devices will be considered under the purview of Drugs and Cosmetics Act,1940, from 1st January, 2020 to 1st January, 2021:

(i) Nebulizer ;

(ii) Blood Pressure Monitoring Devices ;

(iii) Digital Thermometer ; and

(iv) Glucometer.
