Model Factories Rules gets nod; sanitary napkins will need to be mandatorily made available in women’s toilets in Factories

The Ministry of Labour and Employment (“Ministry”) has, in a Notice dated 7th February, 2019 announced that The Minister for Labour and Employment has approved provisions in the Model Factories Rules (“Model Rules”) making it necessary for employers to ensure the availability of sanitary napkins for the use of women workers in factories.

The Ministry has further informed that the Model Rules have been uploaded on the “What’s New” section of its website.

Key Highlights

In the Model Rules, Under Rule 44 pertaining to the provision mandating Latrine accommodation for male and female workers in every factory, new sub rules (c) and (d) have been inserted.

Rule 44 (c) – Sanitary Napkins of adequate quantity conforming to Indian Standards must be provided and maintained in the women’s toilets for their use, and the same must be replenished daily.

Rule 44 (d) – Disposable bins with lids must be provided within the women’s toilets for the collection of napkins. The used napkins must be disposed of as per the procedure approved by the Inspector.
