Ministry of Housing and Urban Poverty Alleviation appoints effective date for certain provisions of Real Estate (Regulation and Development) Act, 2016
The Ministry of Housing and Urban Poverty Alleviation (“Ministry”) has appointed 1st May, 2017 as the date on which certain sections of the Real Estate (Regulation and Development) Act, 2016 (“Act”) shall come into force.
It is pertinent to note that certain sections of the Act, such as Section 2, sections 20 to 39, sections 41 to 58, sections 71 to 78 and sections 81 to 92 have been notified previously and are effective since 1st May, 2016. Vide the recent notification the Ministry has brought into force the remaining sections.
The following provisions of the Act are now in force:
- Sections 3 to 19 – Provisions enabling registration of real estate project and registration of real estate agents.
- Section 40 – Provisions facilitating Recovery of interest or penalty or compensation from a promoter or an allottee or a real estate agent and enforcement of order, etc.
- Sections 59 to 70 – Provisions laying down Offences and Penalties and procedures of Adjudication of contravention of the provisions of the Act/ Orders/Decisions/Directions issued by the Authority.
- Sections 79 to 80 – Provisions relating to bar of jurisdiction of any Civil Court and procedures by which a cognizance of an offence is be taken, in contravention of the provisions of the Act.
