MCA mentions 15.08.2019 as the date on which the remaining provisions of the Companies (Amendment) Act, 2019 will gain effect; Gazette copy issued

The Ministry of Corporate Affairs has through a notification appointed 15th August, 2019 as the date of enforcement of the following provisions of the Companies (Amendment) Act, 2019:

Provisions under the Companies (Amendment) Act, 2019 Corresponding provisions under the Companies Act, 2013
Section 6 Section 26 (Matters to be Stated in Prospectus)
Section 7 Section 29 (Public Offer of Securities to be in Dematerialised Form)
Section 8 Section 35 (Civil Liability for Mis-statements in Prospectus)
Section 14(i)(iii)(iv) Section 90 (Register of significant beneficial owners in a company)
Section 20 Section 132 (Constitution of National Financial Reporting Authority)
Section 31 Section 212 (Investigation into Affairs of Company by Serious Fraud Investigation Office)
Section 33 Section 241 (Application to Tribunal for Relief in cases of Oppression, etc.)
Section 34 Section 242 (Powers of Tribunal)
Section 35 Section 243 (Consequence of Termination or Modification of Certain Agreements)
Section 37 Section 272 (Petition for Winding Up)
Section 38 Section 398 (Provisions Relating to Filing of Applications, Documents, Inspection, etc., in Electronic Form)

Please note that Section 21 of the Companies (Amendment) Act, 2019 which is Section 135 (Corporate Social Responsibility) under the Companies Act, 2013 is yet to be brought into force.
