MCA amends Companies (Accounts) Rules, 2014; NBFCs to whom IND AS is applicable must mandatorily file Forms AOC-4 NBFC (Ind AS) & AOC-4 CFS NBFC (Ind AS); extends time for filing the forms till 31.03.20

In a Notification dated 30th January, 2020 the Ministry of Corporate Affairs (“MCA”) has issued the Companies (Accounts) Amendment Rules, 2020 (“Amendment Rules”) in order to further amend the Companies (Accounts) Rules, 2014 (“Principal Rules”).

The Amendment Rules have inserted a new sub rule 1-A in Rule 12 of the Principal Rules as per which every Non-Banking Financial Institution (“NBFC”) that is required to comply with Indian Accounting Standards (Ind AS) must now mandatorily file the financial statements with Registrar along with Form AOC-4 NBFC (Ind AS) and the consolidated financial statement, (if any) with Form AOC-4 CFS NBFC (Ind AS).

Pursuant to the said amendment, in another Notification dated  30th January, 2020, MCA has informed that the last date for filing Forms AOC-4 NBFC (Ind AS) and AOC-4 CFS NBFC (Ind AS) for the financial year 2018-19 without any additional charges have been extended to 31st March, 2020.

Please note that as per the notification, the likely date of deployment of the e-forms are 31st January, 2020 and 17th February, 2020 respectively. However, the Company forms download page has not yet updated any form in this regard.

The AOC-4 NBFC (Ind AS) is annexed with the Notification.
