Labour Commissioner of Kerala declares 23rd September 2019 a paid holiday for all the employees working in Private Organizations on account of Bye-Elections to the 093 Pala Legislative Assembly Elections

The Labour Commissioner of Kerala (“Commissioner”) through an Order No. EN (2) 13882/2019, dated 7th September 2019, has declared 23rd September 2019  as a paid holiday for all employees working in all Private Enterprises, Private Industrial Centres and all other Private Institutions coming under the purview of the Kerala Shops and Commercial Establishments Act, 1960 on account of the Bye-Election to the 093 Pala Legislative Assembly Elections scheduled to be held on the aforesaid date.

This benefit will be available to all employees including the casual workers, who are ordinarily resident in the Constituency where the poll is taking place and are registered as electors in the Constituency but are serving in an industrial undertaking or establishment located outside the Constituency where they are resident.

Certain points to be considered by the Employers are as follows:

  • There will be no deduction or abatement of wages of any person on account of the holiday being granted under the law.
  • If a person is employed on the basis that he will not receive wages on such a holiday, he will still have to be paid for such a day the wages he would have drawn had the holiday not been granted to him.
