Haryana Labour Department does away with the requirement to obtain prior NOC from State Fire Department and Pollution Control Board for approval of Factory Plans; gains immediate effect

The Labour Department, Government of Haryana (“Department”) had previously mandated that requisite drawings of factory plans under Factories Act, 1948 needs to be submitted online in Auto CAD or any compatible format at hrylabour.gov.in to completely do away with the physical process.

Now, the Department has, in another Order dated 11th February, 2019 further announced that the practice of prior obtaining of No Objection Certificate (NOC) from the Haryana Fire and Emergency Services Department and the Haryana State Pollution Control Board for the approval of Factory Plans under the Factories Act, 1948 is also being  done away with immediate effect.

The Department has further stated that the following conditions are being added while approving the  Factory Plans:

 i)Occupier/s must provide and maintain adequate and suitable firefighting equipment in charge of a trained and responsible person and must obtain NOC from Haryana Fire and Emergency Services Department.

ii) Occupier/s must arrange for the disposal of trade wastes and effluents and must carry out the environmental audit. The Occupier must obtain Consent to Establish / Operate from the Haryana State Pollution Control Board.

Occupiers of factories covered under Factories Act, 1948 have been ordered to adhere to these instructions with immediate effect.
