Government of Tamil Nadu notifies the Tamil Nadu Industrial Establishments (National and Festival Holidays) Amendment Act, 2017

The Government of Tamil Nadu (“Government”) has notified amendments to the Tamil Nadu Industrial Establishments (National and Festival Holidays) Act, 1958 (“Act”), by virtue of the Tamil Nadu Industrial Establishments (National and Festival Holidays) Amendment Act, 2017 (“Amendment Act”).

The Amendment Act amends the Long Title, Preamble, Sub-Section (1) of Section 1 and Section 3. A detailed analysis of the amendment is given below:

Section 3: Grant of National and Festival Holidays

Every employee shall be allowed in each calendar year a holiday of one whole day on the 26th January, the 1st May, the 15th August and the 2nd October and five other holidays each of one whole day for such festivals as the Inspector may, in consultation with the employer and the employees, specify in respect of any industrial establishment.

Section 3: Grant of National, festival and special holidays

(1) Every employee shall be allowed in each calendar year a holiday of one whole day on the 26th January, the 1st May, the 15th August and the 2nd October and five other holidays each of one whole day for such festivals as the Inspector may, in consultation with the employer and the employees, specify in respect of any industrial establishment.

 

(2) Notwithstanding anything contained in sub-section (1), the

Government may, having due regard to any emergency or special circumstances prevailing in the State or any part thereof, by notification, declare any other day as a special holiday, to the employees of the industrial establishments, as it may deem fit.

After the amendment, in the title to the Section, the words “National and Festival Holidays” have been replaced by the Words “National, Festival and Special Holidays”.

 

Also, Section 3 has been renumbered as Section 3(1) and a new sub-section (2) has been added by virtue of this amendment.
