Government of Assam imposes ban on use / manufacture / sale or distribution, etc. of plastic and plastic based items; effective 10th July, 2019

After considering the adverse effects of plastic carry bags on the environment and health, the Government of Assam felt that its usage is having a harmful effect on the environment and human health. With this in the background, the Environment and Forest Department of Assam has issued a notification, dated 10th July, 2019, imposing a complete ban on the use, manufacture, import, supply, store, transport, sale and / or distribute plastic carry bags less than 60 mm and thickness less than 50 microns, short life PVC and all chlorinated plastic bags / sheets / banners / flex / buntings / flags (irrespective of thickness).

What is banned?

 

  1. No person including shopkeeper, vendor, wholesaler, retailer, trader, hawker, salesmen is allowed to use the following items:
  2. Plastic carry bags / Plastic sheets / Multi-layered packaging less than 50 microns,
  3. Plastic cups with diameter less than 60 mm and thickness less than 50 microns,
  4. Short life PVC and
  5. All chlorinated plastic bags / sheets / banners / flex / buntings / flags irrespective of thickness.
  6. No industry / person shall manufacture, import, supply, store, transport, sale and / or distribute plastic carry bags less than 60 mm and thickness less than 50 microns, short life PVC and all chlorinated plastic bags / sheets / banners / flex / buntings / flags (irrespective of thickness) in the State of Assam.

Which items are exempted from the ban?

Plastic used for the following purposes and circumstances are exempted from this notification:

  1. The plastic carry bags manufactured exclusively for export purpose against any export orders in a plastic industry located in Special Economic Zone (SEZ) and Export Oriented Units (EOU).
  2. The plastic bags / multi-layered film / sheet (excluding carry bags) which constitute or form an integral part of packaging in which goods are sealed prior to use at manufacturing / processing units.
  3. The plastic bags and sheets used in forestry and horticulture nurseries against the orders from the Government Departments or from the firms concerned.
  4. Plastic bags / plastic used for packaging of medicines.

 

Penalty:

 

Failure to comply with the plastic ban direction Imprisonment – 5 years; or

Fine –  Rs. 1,00,000/-; or

Both

For continuing contravention Additional fine – Rs. 50,000/- for every day during which such contravention continues after the conviction for the first such failure or contravention.
If contravention continues beyond 1 year after date of conviction Imprisonment – 7 years.
