FSSAI relaxes compliance with regard to organic food consignments that were imported prior to 1st July, 2018

The Food Safety and Standards Authority of India (“FSSAI”) has issued an Order dated 25th July, 2018 emphasizing compliance with the Direction dated 29th June, 2018 by the Food Business Operators (“FBO”) which indicated FBOs to use non-detachable stickers with respect to FSSAI’s organic logo as per the Food Safety and Standards (Organic Foods) Regulations, 2017 (“Regulations”).

The Order has informed that imported food consignments not complying with the Directions, will be rejected.  However, the FSSAI has clarified that in case of such non-compliance, the importers/ Custom House Agents can follow the due procedure of Review Application under Chapter XI of the Food Safety and Standards (Import) Regulations, 2017.

 The FSSAI has also informed that relaxation will be given to the import consignments, claimed as organic food items, which had been exported before 1st July, 2018 and have only reached on or after such date.
