The Food Safety and Standards Authority of India (“FSSAI”) has, vide Notification numbered F. No. Stds / Additives (Misc) / FSSAI – 2017 (“Notification”) dated 28^th December, 2017, directed Food Business Operators (“FBOs”) to operationalize the Standards of Food Additives to be used in various food categories as prescribed by earlier notifications numbered F No. 1 /Additional Additives / Stds / Notification / FSSAI / 2016 and F No. 1 / Additional Additives-II / Stds /Notification /FSSAI / 2017 (together to be referred to as “Previous Notifications”).The present Notification lays down combined provisions of the Previous Notifications. The standards have been directed to be in operation till the final amendment regulation is notified by FSSAI.

Background:

1. FSSAI notification (F. No. 11 / 09 / Reg / Harmoniztn / 2014) dated 5th September, 2016 introduced the Food Safety and Standards (Food Products Standards and Food Additives) Seventh Amendment Regulations, 2016 to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 (“Principal Regulations”). The date of ensuring compliance by the FBOs with the amended regulation was later extended to 31^st December, 2017.
2. During this time period three more separate draft amendment regulations amending the Principal Regulations were approved by the FSSAI and two of them were notified (Previous Notifications) for soliciting comments from affected stakeholders.
3. As the finalisation of these notified draft amendment regulations is not possible by 31^st December, 2017, this Notification (dated 28^th December 2017) has been issued.
