FSSAI operationalises the Food Safety and Standards (Packaging and Labelling) Amendment Regulations, 2018

The Food Safety and Standards Authority of India (“FSSAI”) has, vide notification dated 20th February, 2018, introduced the draft Food Safety and Standards (Packaging and Labelling) Amendment Regulations, 2018 (“Draft Amendment Regulations”), making amendments relating to labelling of blended vegetable oils in the Food Safety and Standards (Packaging and Labelling) Regulations, 2011 (“Principal Regulations”).

The FSSAI has also directed the operationalisation of the Draft Amendment Regulations, with immediate effect, till they are notified.

The Amendments made by the Draft Amendment Regulations:

  • The Draft Amendment Regulations have amended the Second Proviso under Sub-regulation 2.3.3 as follows:

Provided further that in case of label declarations required under 2.4 except in case declaration specifying instructions for use or preparation of the product, the size of letters shall not be less than 3 mm.

 

Provided further that in case of label declarations required under sub-regulations 2.4.2 and 2.4.4 except in case of declaration specifying instructions for use or preparation of the product, the size of numeral and letters shall not be less than 3 mm.

 

 

Previously, the minimum font size requirement of 3 mm was required to be followed for label declarations under all the sub-regulations of Regulation 2.4.

 

After the operationalisation of the Draft Amendment Regulations, this requirement is required to be followed only for label declarations under sub-regulations 2.4.2 and 2.4.4.

 

  • The Draft Amendment Regulations have also amended the format of the label declaration as prescribed under sub-regulation 2.4.2 clause (11) and have also directed that the font size of such label declaration should not be less than 5 mm.

The Draft Amendment Regulations shall come into force on the date of their notification in the Official Gazette.

Background:

Since the Draft Amendment Regulations are in the process of being notified and the Final Regulations will take some more time before being notified and enforced, the FSSAI, keeping in mind the consumer interest and to ensure fair practices in the trade of blended edible vegetable oils, has decided to operationalize the Draft Amendment Regulations.
