FSSAI notifies Food Safety and Standards (Contaminants, toxins and Residues) Third Amendment Regulations, 2018; specifies Maximum Residue Limits for insecticides in food articles

The Food Safety and Standards Authority of India (“FSSAI”) has, in a Notification dated 24th December 2018, issued the Food Safety and Standards (Contaminants, toxins and Residues) Third Amendment Regulations, 2018 (“Amendment Regulations”) to amend the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011 (“Principal Regulations”).

Key Highlights of the Amendment Regulations:

The Amendment Regulations have substituted sub – regulation 2.3.1 of the Principal Regulations relating to the ‘Restriction on the use of insecticides’ with a new sub – regulation 2.3.1. The amendments made therein state that:

i)The expression “insecticide” will have the meaning assigned to it in the Insecticide Act, 1968.

ii)  No insecticides shall be used directly on articles of food. Also, it has been mentioned that the Regulations will not apply to fumigants which are registered and recommended for use as such on articles of food by the Registration Committee, constituted under section 5 of the Insecticides Act, 1968.

iii)  The insecticides specified in the Table (Refer to the attachment) must not exceed the Maximum Residue Limits (MRL) in food articles that have been specified therein.
