E-form DPT-3 (One-time return reflecting outstanding receipt of money or loan by a company but which are not considered as Deposits) yet to be deployed in the MCA portal; MCA clarifies on the next steps

As reported by us earlier, the one-time return in Form DPT-3, was supposed to furnished by every company before the Ministry of Corporate Affairs (“MCA”) within April 22, 2019. However, the e-form has still not made available in the MCA 21 Portal.

The Ministry had earlier through the Companies (Acceptance of Deposits) Amendment Rules, 2019 (“Amendment”), notified that in addition to the existing requirement of filing returns of deposit, Form DPT 3 shall also be used for filing particulars of transaction not considered as deposit by every company other than a Government Company by April 22, 2019.

In view of the delay in deployment of the revised Form DPT-3, and in order to avoid inconvenience on account of various factors, MCA has through a circular dated April 12, 2019, stated that the additional fee, as provided under the Companies (Registration Offices and Fees) Rules, 2014, shall be levied after 30 days from the date of deployment of the DPT- 3 form on MCA 21 portal.

Further, the circular states that the filing of returns data on deposits should be filed upto 31st March, 2019 (as opposed to 22nd January, 2019 which was originally indicated). Rule change will be issued separately.
