Chandigarh upholds the spirit of Swachh Bharat Mission by proposing a new Bye-Law for Solid Waste Management

The Municipal Corporation of Chandigarh (“MCC”), in a Notification dated September 11, 2018,  has published a draft copy of the Municipal Corporation Chandigarh Solid waste Management Bye-laws 2018 (“Draft Bye-laws”) with a view to regulate proper disposal and collection of solid waste in the Municipal Area of Chandigarh. The Draft Bye-laws will supersede the Chandigarh Municipal Corporation (Sanitation and Public Health) Bye laws 1999 and the amendments made under will be repealed on the enforcement of the Bye-law.

MCC further invited comments and suggestions from the stakeholders, which are to be submitted within 11th October, 2018 addressing to Sh. Kamal Kishor Yadav (IAS), Commissioner of Municipal Corporation Chandigarh.

On 4th September, 2018, the Local Government Department has notified the Chandigarh Solid Waste Management Policy with a view applies to all waste generators under the jurisdiction of the Union Territory of Chandigarh. Subsequently, the Bye-Law has been introduced which seeks to bring a regulatory management of solid waste by scientific processing, segregation and disposal as per Solid Waste Management Rules, 2016 and penalty for non-compliance.

Applicability

The Draft Bye-Laws provide a process for organizing, regularizing, disposing and handling of solid waste within the territorial limits of Chandigarh’s municipal bodies. The Draft bye-Laws apply to all Waste Generators and Bulk Waste Generators. Waste generators may be every residential premises and non-residential establishments, which generate solid waste. The Draft Bye-laws also define who an occupier is and it includes a person who is paying rent for using any land/ building, an owner of land/building/ a licensee in occupation of any land/building.

Key Highlights of the Draft Bye Laws:

  1. The waste generators and bulk waste generators will have to segregate  the solid waste into the following categories, at source:
  • Non-biodegradable (dry waste)
  • Biodegradable (wet waste)
  • Hazardous waste (Domestic hazardous waste in case of non-bulk waste generators) and deposit it into covered waste bins and handover segregated waste to designated waste collectors as per the direction of MCC.
  1. Bulk Waste Generator has been defined as the owner, occupier of buildings occupied by the Private Companies, Hospitals, Nursing Homes, Commercial Establishments, recreation/entertainment complexes generating more than 100 kg per day of waste on an average rate (or any other place notified by the MCC),
  2. The colour of bins for storage of segregated waste has been suggested as following:
  • Green-    for biodegradable waste,
  • Blue   –    for non-biodegradable or dry waste,
  • Black –    for domestic hazardous waste.
  1. Obtain license before organizing an event or gathering more than 100 persons 3 days prior to the event,
  2. Do not burn any solid waste at any private or public property,
  3. Waste Generators have been prohibited from littering in any private or public property,
  4. An Extended Producer Responsibility has been imposed on the manufacturers, producers and brand owners for segregation, collection, storage, recycling, transportation, treatment, processing or disposal or any other assigned activity.
  5. The User Fee for Solid Waste Management and Fine are provided in Schedule I and Administrative Charges in Schedule II.

Penalty:

In case of non-compliance with the Draft Bye-Law, a maximum fine of Rs. 99,500 will be imposed. The concept of spot-fine has also been introduced which will be charged by Designated Officers.
