Assam Pollution Control Board clarifies the other mandatory requirements for which Green Category industries may be inspected

Pursuant to the update in the trail mail exempting Green Category industries from inspection, except in cases of public complaints, legal cases and other mandatory requirements, thePollution Control Board, Assam (“Board”) has, vide Notification (no. WB / G-1248 / 15-16 / 103) dated 16th January, 2018, issued clarification regarding the meaning of the expression ‘other mandatory requirement’.

The words ‘other mandatory requirement’ have been clarified as follows:

  • Requirement as per Supreme Court Order pertaining to installation of Primary ETP irrespective of category of industry and similar orders issued by judiciary including National Green Tribunal (“NGT”) from time to time.
  • Compliance of standards (ETP/Emission) especially in case of amendments by Central Pollution Control Board (CPCB) or Ministry of Environment, Forest and Climate Change  time to time.
  • If the industry falls in the vicinity of notified areas like Eco-Sensitive Zone/ Wetland area under the purview of Wetland Rules and No Development Zone.

This clarification shall come into force with immediate effect.
